PROVE IT!® HAD TO PROVE IT!®
Armed with only the truth and the merits of my registration, I represented myself pro se in U.S. Federal Court without formal legal training. In a high-stakes battle against Adidas America Inc. in federal court, their attorneys attempted to strip away my trademark rights by alleging fraud. Furthermore, when I brought suit against Under Armour for utilizing my trademarked slogan without permission, our legal battle resulted in a confidential settlement agreement. When Toyota USA Inc. and their marketing affiliates capitalized on my mark with the “Toyota Tundra PROVE IT” campaign, I took decisive action by initiating a federal trademark property rights lawsuit against them in the Arizona District Court (Case No. 2:10-cv-00857). I went toe-to-toe with these corporate giants and successfully defended my mark, securing the legal resilience of my brand (documented publicly under search terms like “Adidas Prove It”, “Under Armour Calmese”, and “Calmese v. Toyota”).

As a Black small business owner in the United States, holding an intensely sought-after athletic trademark has made my brand a prime target for major corporate interests. Companies like Toyota, Adidas, and Under Armour recognized the commercial power of "PROVE IT!"—launching multi-million-dollar campaigns utilizing the phrase—yet instead of doing constructive business, they deployed high-powered legal teams against me.
EVERYONE has something to prove... athletes, teams and fans have to prove it every year on and off the court, on and off the field, in and out of the ring, on and off the ice, at home and at work ... every day.
