"...Adidas America Inc., now moves for cancellation of defendant’s registered trademark. Plaintiff essentially argues that because Michael Calmese is not a multi-national corporation with massive sales and marketing, he does not have the same rights in his trademark as a company like adidas. The Plaintiff’s legal staff is not the inheritors of the divine rights of kings. Likewise, do not our laws exist to protect my rights to compete against a major corporation and protect my intellectual property from unauthorized use? In the eyes of corporate attorneys a small minority start up competitor may seem a vexatious “upstart”, but do not the courts exist to protect innovators from the wealth and power of global goliaths? In the current proceedings, adidas has the temerity to ask the court, for the second time, to act in compliance with their plea to protect an industrial shark from an upstart minority minnow and cancel Defendant’s trademark.
Though Plaintiff may term Defendant’s argument “vexatious”, the current action raises vexatious motivation to heights of arrogance …." see documentary Coming Soon!
